After a period during which the theological categories of sin and forgiveness were ignored or trivialized, presently these notions are being rediscovered. What could their impact be on bioethics, either in the narrow sense of medical ethics, or in the more encompassing sense of the ethics of the life sciences? This essay begins with describing the processes of transcending and ethitization, which gave rise to the biblical notion of sin. It portrays the theological foundation of sin in terms of a (...) twofold refusal of proper relations to God and other humans. Through the practise of confession in the face of God (coram deo), sin is placed into a horizon of hope for forgiveness and reconciliation. The heuristic and hermeneutical significance of these categories results from their introducing a “surplus value,” which transcends biological and ethical considerations. This additional dimension is illustrated in view of care (cura) for the injured, and in view of individual as well as collective willingness to forgive. (shrink)

One of the more draining aspects of being a clinical ethicist is dealing with the emotions of patients, family members, as well as healthcare providers. Generally, by the time a clinical ethicist is called into a case, stress levels are running high, patience is low, and interpersonal communication is strained. Management of this emotional burden of clinical ethics is an underexamined aspect of the profession and academic literature. The emotional nature of doing clinical ethics consultation may be better addressed by (...) utilizing concepts and tools from clinical psychology. Management of countertransference, the natural emotional reaction by the therapist toward the patient, is a widely discussed topic in the psychotherapeutic literature. This concept can be adapted to the clinical ethics encounter by broadening it beyond the patient-therapist relationship to refer to the ethics consultant's emotional response toward the patient, the family, or other members the healthcare team. Further, it may aid the consultant because a recognition of the source and nature of these reactions can help maintain ‘critical distance’ and minimize bias in the same way that a psychologist maintains neutrality in psychotherapy. This paper will offer suggestions on how to manage these emotional responses and their burden in the clinical ethics encounter, drawing upon techniques and strategies recommended in the psychotherapeutic literature. Using these techniques may improve consultation outcomes and reduce the emotional burden on the clinical ethicist. (shrink)

In this paper we argue that dissociative identity disorder (DID) is best interpreted as a causal model of a (possible) post-traumatic psychological process, as a mechanical model of an abnormal psychological condition. From this perspective we examine and criticize the evidential status of DID, and we demonstrate that there is really no good reason to believe that anyone has ever suffered from DID so understood. This is so because the proponents of DID violate basic methodological principles of good causal modeling. (...) Review of Primary Ousia: An Essay on Aristotle's Metaphysics Z and H, by Michael J. Loux (Cornell University Press: 1991).

In this essay I elaborate a particular, and particularly important, morality: the morality of human rights. Next, I ask the ground-of-normativity question about the morality of human rights and go on to elaborate a religious response. Then, after explaining why one might be skeptical that there is a plausible secular response to the ground-of-normativity question, I comment critically on John Finnis's secular response. Finally, I consider what difference it makes if there is no plausible secular response to the ground-of-normativity question.

This article considers the theme of discernment in the tradition of Ignatian spirituality emanating from the Spiritual Exercises of St Ignatius of Loyola, the founder of the Society of Jesus. After a brief introduction which addresses the central problematic of bad influences that manifest themselves as good, the article turns to the life and work of two Jesuits, the 16th C English missionary to India, Thomas Stephens and the 20th C French historian and cultural critic, Michel de Certeau. Both kept (...) up a constant dialogue with local culture in which they sought authenticity in their response to ‘events’, whether a hideous massacre which shaped the pastoral commitment and writing of Stephens in the south of the Portuguese enclave of Goa or the 1968 student-led protests in Paris that so much affected the thinking of de Certeau. Very different in terms of personal background and contemporary experience, they both share in a tradition of discernment as a virtuous response to what both would understand as the ‘wisdom of the Spirit’ revealed in their personal interactions with ‘the other’. Consider the following situation. It is the first day of school, and the new third-grade students file into the classroom to be shown to their seats for the coming year. As they enter, the third-grade teacher notices one small boy who is particularly unkempt. He looks to be in desperate need of bathing, and his clothes are dirty, torn and tight-fitting. During recess, the teacher pulls aside the boy's previous teacher and asks about his wretched condition. The other teacher informs (...) her that he always looks that way, even though the boy's family is quite wealthy. The reason he appears as he does, she continues, is that the family observes an odd practice according to which the children do not receive many important things – food, clothing, bathing, even shelter – unless they specifically request them. Michael J. Loux here presents a fresh reading of two of the most important books of the Metaphysics, Books Z and H, in which Aristotle presents his mature theory of primary substances. Focusing on the interplay of Aristotle's early and late views, Loux maintans that the later concept of ousia should be understood in terms of a theory of predication that carries interesting implications for contemporary metaphysics. Loux argues that in his first attempt in identifying ousiai in the Categories, (...) Aristotle encountered a set of ontological problems which he wrestled with again in Metaphysics Z and H. In the Categories, where the primary realities are basic subjects of predication construed in essentialist terms as things falling under natural kinds, familiar particulars are the primary ousiai. In subsequent works, Aristotle holds that since familiar particulars come into being and pass away, they must be composites of matter and form; and in Metaphysics Z and H, he explores the implications of this insight for the search for ousia. Maintaining that the substantial forms of familiar particulars are the primary ousiai, the later Aristotle interprets forms as predicable universals rather than as particulars, each uniquely possessed by a single object. If a man born blind were to gain his sight in later life would he be able to identify the objects he saw around him? Would he recognise a cube and a globe on the basis of his earlier tactile experiences alone? This was William Molyneux's famous question to John Locke and it was much discussed by English and French empiricists in the eighteenth century as part of the controversy over innatism and abstract ideas. Dr Morgan examines the whole history (...) of this debate: Locke's own (negative) answer to the question, the contributions of Berkeley, Condillac, Diderot and Voltaire and the factual accounts of early cataract operations and modern laboratory studies. He shows how this debate is involved in the development and eventual separation of philosophy and experimental psychology after the eighteenth century and considers why the original question is effectively still unanswered. This is one problem-area with its intricate cluster of connected conceptual and technical difficulties which suggests the need for some reunion or at least collaboration between the two subjects. Stemming from a reading of Hegel’s account of the struggle for recognition in the Phenomenology of Spirit, Kojève argued that death is the central notion of Hegel’s philosophy. I will discuss several themes in relation to this claim of Kojève’s interpretation of Hegel, namely the themes of freedom, individuality, and historicity. I will also discuss Kojève’s reading that Hegel rejects both all conceptions of the afterlife, and too the belief in the afterlife as a manifestation of the “unhappy consciousness”. Simon Evnine’s Making Objects and Events: A Hylomorphic Theory of Artifacts develops amorphic hylomorphism. I critically discuss three of its main themes. One theme is its attempt to do the work of form without forms. A second theme is the requirement that hylomorphs have ‘metabolisms at work’. A third theme is the use of artifacts as the paradigms for hylomorphs. I will raise some criticisms of each of these themes. Although the themes might at first appear disconnected, I believe the (...) third underwrites the first two. So the criticisms of the third theme also bear on the rest. (shrink)

Recently, Kroedel and Schulz have argued that the exclusion problem—which states that certain forms of non-reductive physicalism about the mental are committed to systematic and objectionable causal overdetermination—can be solved by appealing to grounding. Specifically, they defend a principle that links the causal relations of grounded mental events to those of grounding physical events, arguing that this renders mental–physical causal overdetermination unproblematic. Here, we contest Kroedel and Schulz’s result. We argue that their causal-grounding principle is undermotivated, if not outright false. (...) In particular, we contend that the principle has plausible counterexamples, resulting from the fact that some mental states are not fully grounded by goings on ‘in our heads’ but also require external factors to be included in their full grounds. We draw the sceptical conclusion that it remains unclear whether non-reductive physicalists can plausibly respond to the exclusion argument by appealing to considerations of grounding. (shrink)

Costa It is well known that Hume distinguishes between strict identity and the identity that applies to changeable objects, such as physical objects or persons. Identity judgments that we make with respect to changeable objects are based upon a number offeatures that determine how likely it is for the mind to confuse the perception of such objects with the continuous (...) perception ofan unchanging object. Strict identity can apply only to the latter (T 203-18, 253-63). Even the idea of strict identity, however, is considered by Hume to be a fiction and based at bottom on a confusion. I will concentrate here on Hume's account of the idea of strict identity, and I will try to explain the precise sense in which Hume considers this idea to be a fiction and based upon a confusion. Some very able commentators have dealt with this topic before, but none of the accounts with which I am familiar give adequate attention to the full context of Hume's account in the Treatise. They do not note the degree to which his account develops out ofand depends upon verybasic features of his system, such as his characterization of relations as complex ideas (T 13) and his theory of abstract ideas (T 17-25). Nor do the accounts note the degree to which the idea of strict identity is tied to the idea of time without change (T 64-5), and through that, to the idea of a vacuum (T 53-65).2 I shall argue that viewing Hume's account of the idea of strict identity in light of his accounts of complex and abstract ideas, his account ofthe idea ofa vacuum, and his account oftime without change makes considerable sense of it, at least as an account that it is reasonable for him to hold. I will proceed by examining each of these features in turn. Along the way I hope to make some novel and enlightening interpretative points with regard to complex ideas, abstract ideas, the idea of time, and the idea of a vacuum. I Hume tells us that simple perceptions (whether impressions or ideas) are those which admit of no distinction nor separation, whereas complex perceptions are contrary to these and may be distinguished into parts (T 2). The example that he immediately gives, however, at best clouds the distinction he has made. He says, Tho' a particular Volume XVI Number 1 MICHAEL J. COSTA colour, taste, and smell are qualities all united together in this apple, 'tis easy toperceive they are not the same, but are at least distinguishable from each other (T 2). This may make it seem that simple ideas are universals and that a mere distinction ofreason (see T 24) is enough to show that a perception is not simple; but I think that Hume did not have universals in mind at all with respect to the simple/complex distinction. Every perception-proper for Hume is a particular, an existent (T 66-7). There is, indeed, something more to a universal or abstractideafor Hume than a particular idea, but this something more is a disposition and not another idea or perception. I see no evidence that Hume intended the simple/complex distinction to apply to the dispositions connected with abstract ideas. Note that in the apple example, the ideas mentioned are of different sense modalities. They can be distinguished psychologically, and not merely as distinctions of reason. One can form a distinct idea of the colour of the apple without forming any idea of taste or smell. The shape of the apple would not be distinct in the same way. Any idea of the shape of the apple would, for Hume, also be an idea of some colour or other. This becomes important when we note that Hume characterizes space and time (indeed, all relations) as complex ideas (T 13). He does not mean that these ideas are logically analyzable; he means that any instance of these ideas is psychologically analyzable. Forrester’s proposed seventh style of reasoning – thinking in cases – functions as an analogous, dyadic relationship that, whilst indebted philosophically to the logical reasoning and semiotics of Charles Peirce, is prone to creating feedback loops between induction and deduction, precluding novel abductive hypotheses from advancing medical knowledge. Reasoning with a Peircean triadic model opens up the contexts and methods of meaning-making and reasoning through medical cases, and the potent influence of their genre conventions, to intellectual critical scrutiny. Vitally, it (...) offers a third mode – abduction – that this article argues needs to be reintroduced into Forrester’s model of reasoning with cases. This article demonstrates this by applying a Peircean triadic model of reasoning to Forrester’s own model, tracing a shared genealogy but one in which the abductive element was lost. The article goes on to illustrate the explanatory and predictive potential of Peircean abductive reasoning and the necessary re-theorising of the case this entails. This argument is supported through an analysis of early case reports of what would become HIV/Aids, drawn from the Case Records of Massachusetts General Hospital series in the New England Journal of Medicine. Inter alia, such a theory would provide (...) a principled means for striking a balance, or making trade-offs, between these values in cases of conflict. Recent developments in public health ethics have made progress in thinking about how to make trade-offs between liberty and utility in particular. While public health ethicists often claim that the least restrictive alternative should be used to achieve the public health goal in question, I argue that a plausible but under-recognized idea is that the least restrictive alternative might sometimes involve improvement of global health via redistributive taxation—i.e., rather than coercive social distancing measures. I conclude by demonstrating that the proportionality principle leaves open the question of when exactly utility outweighs liberty or vice versa—and I argue that, rather than speaking about the morality of liberty-infringing public health interventions in categorical/binary terms, it would be more fruitful and realistic to think and speak about the degree to which a liberty-infringing public health intervention is morally appropriate. In this paper I argue that Michael Friedman's conception of the contitutive a priori faces two serious problems. These two problems show that the view collapses into a form of conventionalism.

This paper concerns a distinction between circumstantial truths that hold because of the circumstances and acircumstantial truths that hold regardless of, or transcend, the circumstances. Previous discussions of the distinction tended to focus on its applications, such as to modality, logical truth, and essence. This paper focuses on developing the distinction largely, but not entirely, in abstraction from its potential applications.
